Terms of Use

Flashost Holding Ltd is the company providing all platform services, it’s registered address is Unit W9A1, Ladytown Business Park, Newhall, Naas, Co. Kildare, W91 T211, Republic of Ireland. Flashost, in turn, provides Employer of Record (EOR) services to employers through its partner and subsidiary companies. The contract between the employees will be with the local EOR company, and the contract to provide these employees as hired staff to employers globally will also be with the local EOR company. Flashost, as the platform, facilitates all other services, including sourcing, profiling, and managing payment. The platform and service are trading as Flashost.io and referred to below as the platform and service.

General Terms

By using the platform, Flashost.io and our services, you confirm that you are an adult over age 17, so at least age 18 plus and that you have the authority to enter into this agreement. When you create a profile or open an account on Flashost.io you are accountable and responsible for it, including for safeguarding its security. You are responsible for all activities that occur under your account.

Be aware that your account will be taken down by the platform in the event of entering false contact or profile information of any kind that, in the opinion of the company, is intended to mislead. This extends through our compliances processes when you open the account, so for the absence of doubt, we require you to declare any fact as a material fact if it would influence the judgement of prudent compliance.

The company confirms that we have authority to perform the services under these Terms and Conditions and we will not be liable for damages caused by any acts or omissions by you. You are required to immediately notify the company of any unauthorized uses of your account and breaches its security.

You confirm that you have never been subject to prosecution or received a custodial sentence of any kind or received a sanction by a regulator or licensing authority for misrepresentation or fraudulent behavior of any kind and that no terms in this agreement that would prevent you from complying with it.

The company may delete, disable or suspend your profile and account if, in our opinion, you have violated any of these terms, to place our reputation at risk and that in such an event you may not use the platform or services again.

Your content

You own your own content, the data, material and information you enter on the platform and you are exclusively accountable and responsible for its integrity, accuracy and warrant that it does not contravene any third-party Intellectual Property and that you have freedom to use the content that you upload to the platform.

When there is information on the platform that is wrong due errors or omissions, we reserve the right to correct term, and to change or update information. Naturally we maintain the right, at our discretion to remove or reject harmful, objectionable content especially content that is intended to incite hatred, to mislead or any content that is opposed to the general conditions of this agreement. You also agree not to attempt to cause harm in any behavior while using the platform extending to transmitting harmful technologies and viruses, breach the intellectual property of any third party on the platform or attempt to duplicate, copy or modify the platform and to act lawfully at all times.

Should you violate these terms, we reserve the right to suspend or terminate your access to the platform, without any liability to you. For registered Flashost.io users the platform reserves the right to use 'Cookies' as part of its monitoring and analytic processes to detect problems and misconduct. Payments on the Platform

We make payment for services using Stripe. You shall pay all charges to your account in keeping with the billing terms to which you will have agreed. We reserve the right to ensure compliance with Anti-Money Laundering principles and processed and you agree to provide photo identification, utility bills not more than three months old and any other certification we require. We have the right to change products and pricing at any time and the right to refuse services and can, at our discretion, restrict or cancel services purchased, notifying you by email.

Third Party Websites

Any link on the platform to third party websites does not constitute endorsement or approval and recommend that you independently and carefully undertake due diligence on any such third-party site.

Disclaimer

You agree to use Flashost.io at your own risk. The information you obtain from the platform is on a current 'best efforts' basis. It is not a substitute for expert advice, whether on legal, taxation, jurisdictional or accounting purposes. Compliance with national laws on taxation is a matter between taxpayers and tax authorities and, while we take every reasonable effort to ensure best practices in employment related to compliance matters, the platform in not a substitute for either legal or taxation advice and should not be regarded as same.

We make no claims as to the fitness that the services requested on the platform will satisfy your needs or that they will not be free from errors and omissions or interruptions or make any claims as to the accuracy or reliability of any information obtained through the platform.

You agree and grasp that any data downloaded or otherwise obtained through the use of the platform and services is at your own risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material. You are advised to consult with professional advisors; lawyers, tax advisors, accountant before accepting these terms.

In no event and to the fullest extent permitted by law, will our staff, our officers, directors, employees, affiliates, agents, suppliers or licensors, be liable to any person for any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use or content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, including, without limitation, contract, tort, warranty, breach of statutory duty, fraud, negligence or otherwise, even if the Company, has been advised as to the possibility of such damages or could have foreseen such damages.

Governance Commitments

The Company is committed to monitoring the carbon footprint of our business, implementing measures to reduce our carbon emissions as much as possible, to contribute towards achieving Net Zero in a reasonable time frame and to fully comply with all applicable anti-slavery and human trafficking laws.

All rights and restrictions contained in these terms are applicable and binding but only to the extent that they do not violate any applicable laws. If any portion of any provision of these terms shall be held to be illegal or unenforceable by a court, it is the intention of both parties to these terms that the remaining provisions or portions thereof shall constitute their agreement and remain in force. We reserve the right to modify the terms relating to the platform or services at any time and continued use of the platform thereafter shall constitute your consent to such changes.

Jurisdiction

The formation, interpretation, and performance of these terms and any disputes arising out of it shall be governed by the laws of Pakistan.

Acceptance of these terms

You acknowledge that you have read these terms and agree to them and to be bound by the terms otherwise you are not authorized to use or access the platform and its services.
